Everything You Need to Know About the New Legislation

On April 3, 2025, the so-called anti-eviction law comes into force in Spain. Numerous reports about the changes are appearing in the media. What do they practically mean for Polish investors? We are clearing up the doubts!

Short-term rentals are very popular on the Costa del Sol. This sunny region attracts tourists like a magnet with its exceptional views, beautiful beaches, diverse restaurants and services, and golf courses. The large supply of holiday apartments has, in turn, resulted in changes to the law concerning tourist rentals.

Changes in the short-term rental market in Spain – what to expect?

The first issue is licenses for short-term rentals. It is crucial whether you are just starting to rent out or are already running such a business. In the first case, you must obtain the consent of the majority of the community (3/5). If, however, the property was registered as a short-term rental before April 3, 2025, approval is not required.

And what if you do not comply with the new law? You must then be prepared for the neighbors to take legal action. This can result in really high fines, from 30,000 to 600,000 euros, or even a rental ban. To avoid these consequences, you need to know what needs to be done.

Practical tips for property owners

First and foremost, ensure you have the best possible relationship with your neighbors. Their goodwill means a greater chance of consent. Also, stay up-to-date with legal changes. Follow Spanish media and key opinion leaders. It is also a good solution to entrust rental management to professionals.

At International Investment Marbella, we handle this comprehensively. We not only assist with the purchase but can also take on all aspects related to rentals – including adaptation to the latest regulations. This way, you don’t have to worry about encountering problems due to non-compliance with the new law or even the fact that you are not present on site.

New law protects holiday property owners

Who, when delving into the Spanish real estate market, has not encountered the term “okupas”? This problem is particularly common in large cities. Illegal occupants unlawfully occupy properties that have been uninhabited for a long time. In tourist regions like the Costa del Sol, this phenomenon practically doesn’t occur. Those who feared it anyway can breathe a sigh of relief. A law is coming into effect that changes the procedures regarding illegal occupants.

From now on, cases are to be processed within 15 days of reporting, and a verdict should be issued within 3 days of the end of the hearing. What’s more – as the owner, you will have the right to cut off utilities (electricity, water, and gas) to those who have illegally occupied the apartment. Previously, this was treated as a crime of coercion.

Although the new regulations are causing much emotion, a good knowledge of the law will help avoid negative consequences. Both property owners and residents want a regulated short-term rental market. This means limiting unfair practices and protecting the rights of all parties.

3 kwietnia 2025 roku w Hiszpanii wchodzi w życie tzw. ustawa antylokatorska.
